Swansea care home’s legal challenge over National Miniumum Standards

The owners of a Swansea care home say a lack of clarity by CSSIW over the new National Minimum Standards on en-suite facilities is having an impact on their plans to sell the business.

The owners of Fairleigh House in Sketty say CSSIW should make clear now that it will not require any new registered provider to install additional en-suite facilities as this could put off potential buyers.

CFW’s senior policy adviser, Mary Wimbury, said: “This is an issue which could affect care home business owners who wish to sell going concerns that do not have en-suite facilities. It will also have an impact on potential investors and the ability of care home owners to raise funds in future for expansion or improvements.

We hope the legal challenge, which is being handled by CFW’s solicitor Alison Castrey, will help clear up matters for the owners and for other providers in the future.”

All registration conditions are changing under the Registration and Inspection Act and CSSIW is in ongoing discussions with the Welsh Government about the implementation of the Act.
